One facebook post can’t hurt right? Wrong.
We’re going to tell you why a single social media post against the advise of your attorney can hurt your case.
We always tell our clients, whether personal injury, employment discrimination or medical malpractice, to generally stay off of social media during the course of their case.
The problem, of course, is that for many people social media – facebook in particular – has become a way of life. They simply can’t imagine not updating their status! The problem is that other people are watching, and what may seem like an innocent post can come back to hurt.
Let’s say that you were hurt in a car accident and broke your leg. We’ve filed a lawsuit on your behalf alleging that you’re having difficulty walking. On facebook you make what you think is an innocent comment – had a great hike yesterday in Lake Placid.
Then the defense attorney asks for or sees your facebook posts, and all of a sudden they have what they believe is evidence that you’ve been lying about the seriousness of your injury. And believe me, they’ll do everything they can to use it against you.
So do yourself a favor. If you’re the victim of an accident, and your attorney tells to say off social media, stay off social media. You’ll be happy that you did.
