Scott M. Peterson, founding partner of D’Orazio Peterson LLP, obtained a jury verdict for a plaintiff in a whistleblower retaliation lawsuit in Fulton County, NY Supreme Court.
The verdict followed a six day trial during which the jury heard testimony from approximately ten witnesses. The Plaintiff, a former asbestos demolition employee, brought the claim after he was fired for making complaints about improper and illegal asbestos removal from multiple worksites.
The employer strongly defended itself, and presented a defense focused on its belief that the plaintiff was not an employee at the time he made the complaints.
After six days of trial and closing arguments, the jury reached a decision for the Plaintiff after only forty minutes of deliberations.
