Will Your Personal Injury Lawsuit go to Trial?

This is a question that we frequently receive – will my case go to trial?

The short answer is – we can't say for sure. Statistically the large majority of lawsuits are resolved before trial, often through settlement.

Personal injury lawsuits may be settled early, at the beginning of a case, up through and including at any time during trial. More and more mediation is being used by law firms as a method of settling lawsuits.

Ultimately when we consider potential lawsuits we approach cases from the perspective of trial. We expect that our cases will go to trial, and we are comfortable with that expectation. Many lawyers aren't. You should ask a potential lawyer if he or she actually takes cases to trial, or whether they will farm your case out or bring in trial counsel. If they do you may be comfortable with this, but it is important to be sure that you know fully what to expect going in to the attorney client relationship.
